In May 2022, Germany's Federal Labour Court (Bundesarbeitsgericht) ruled that employers are already obligated under the Occupational Health and Safety Act (ArbSchG) to record the start, end, and duration of every employee's working time — a duty that follows from a 2019 European Court of Justice ruling. A separate reform to write this explicitly into the Arbeitszeitgesetz is still under discussion in the Bundestag, but the underlying recording duty isn't waiting on that reform: it applies today.
